Terms of Service

1. Agreement to these Terms
These Terms of Service ("Terms") are a binding agreement between you and Stonebridge Digital Studios LLC, a Florida limited liability company doing business as PrepLabs ("PrepLabs," "we," "us," or "our"), governing your use of PrepLabs: Ham Radio Exam Prep, including its website, web application, and mobile apps (together, the "Service"). By creating an account, making a purchase, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old to create an account or make a purchase. The Service is offered only to residents of the United States; by using it you represent that you are accessing it from the United States.
3. The Service
The Service is a study tool that helps you prepare for the amateur-radio license examinations administered under the authority of the U.S. Federal Communications Commission (FCC). The Service presents practice questions drawn from the publicly published amateur-radio examination question pools, tracks your study progress, and offers optional paid content. We may add, change, or discontinue features at any time. If you use a beta or pre-release version of the Service, you understand that beta features may be unstable, that beta data or progress may be reset, and that any feedback you provide may be used by us without obligation to you.
4. Your Account
You are responsible for the activity under your account and for keeping your login credentials secure. Provide accurate information, keep it current, and notify us promptly of any unauthorized use. One account per person. You may delete your account at any time from within the Service. Please note: because we do not keep personal information after deletion, purchases made on the web cannot be restored after you delete your account. Purchases made through the Apple App Store or Google Play belong to your store account and may be restorable through that store's own restore mechanism, subject to its records and policies.
5. What You Are Purchasing
PrepLabs offers one-time purchases that unlock specific study content (for example, a question-pool tier). These are one-time unlocks, not subscriptions — there is no recurring charge and nothing to cancel. Purchases made on the web are processed by Stripe; purchases made in our mobile apps are processed by the Apple App Store or Google Play and are also governed by that platform's terms. Prices are shown before purchase and may change prospectively; applicable taxes may be added.
6. License to Purchased Content
When you buy an unlock, we grant you a personal, non-exclusive, non-transferable, revocable license to access that content through the Service for your own exam preparation. You may not resell, sublicense, share, redistribute, or commercially exploit the content or the Service.
7. Refunds
Because purchases deliver digital content that is unlocked immediately, all purchases are final and non-refundable once the associated content has been unlocked, except: (a) where a refund is required by applicable law; and (b) purchases made through the Apple App Store or Google Play, which are subject to that platform's own refund policies and processes. If you believe you were charged in error, contact us at support@bypreplabs.com and we will review it in good faith.
8. No Guarantee of Exam Results
The Service is designed to prepare you effectively for the FCC amateur-radio exams. We do not and cannot guarantee that you will pass any examination, on your first attempt or at all. Your results depend on your own study and performance and on factors outside our control. Any pass rates, timelines, or statistics we may publish are general information, not a promise of individual results.
9. Not Affiliated with the FCC or Exam Administrators
The Service is an independent study tool. We are not affiliated with, endorsed by, sponsored by, or acting on behalf of the FCC, the ARRL, the NCVEC, or any Volunteer Examiner Coordinator (VEC) or Volunteer Examiner. Exam questions are taken from the publicly available question pools published by the NCVEC. We do not administer exams or issue licenses.
10. Educational Content; Official Sources Govern
The study materials, answer choices, and explanations in the Service are provided for exam preparation and general educational purposes only. They do not constitute legal advice and are not an authoritative statement of applicable law or examination requirements. Amateur Radio Service rules are established by the U.S. Federal Communications Commission (FCC), and amateur radio examination question pools are developed and published by the NCVEC Question Pool Committee. Applicable FCC rules and official NCVEC question pools, including any amendments, revisions, or errata, shall govern. In the event of any conflict or inconsistency between the Service's content and an applicable official source, the official source shall control.
11. Acceptable Use
You agree not to: (a) copy, scrape, harvest, or redistribute the content or question data; (b) reverse-engineer, interfere with, or attempt to gain unauthorized access to the Service; (c) use the Service to violate any law or the rights of others; or (d) share, resell, or transfer your account or purchased content.
12. Intellectual Property
The Service and its original content, features, branding, and the "PrepLabs" name and marks are owned by Stonebridge Digital Studios LLC and protected by law. The amateur-radio examination question pools are published for public use by the National Conference of Volunteer Examiner Coordinators (NCVEC); our selection, arrangement, explanations, and software are our own.
13. Third-Party Services
The Service relies on third-party providers (including Supabase, Stripe, Vercel, and the Apple and Google app stores). Your use of those services through PrepLabs may also be governed by their terms, and we are not responsible for their acts or omissions.
14. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that content is complete or current.
15. Limitation of Liability
To the maximum extent permitted by law, PrepLabs and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability arising out of or relating to the Service — in the aggregate, across all claims — will not exceed the amount you paid us for the specific purchase giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
16. Indemnification
You agree to indemnify and hold harmless Stonebridge Digital Studios LLC and its owners from claims and expenses arising out of your misuse of the Service or your violation of these Terms or of any law or third-party right.
17. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or misuse the Service. Sections that by their nature should survive termination (for example, Sections 12, 14–16, and 18) survive.
18. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Before filing any claim, you agree to first contact us at support@bypreplabs.com and attempt to resolve the dispute informally for at least 30 days. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Brevard County, Florida, and you consent to their jurisdiction.
19. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and surface notice in the Service. Your continued use after changes take effect means you accept the updated Terms.
20. General
If any provision of these Terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy, are the entire agreement between you and PrepLabs regarding the Service and supersede any prior understandings. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms were written in English. If we provide a translation, the English-language version controls in the event of any conflict or inconsistency; the translation is provided for your convenience only.
